With the explosion of new roller derby leagues around the world, I though others might benefit from the exchange so here you go:

HELP PLEASE........... Question: I am part of a new league and we have just broke into teams. We have thought of all kinds of great ideas for names, colors, and themes.... But, the names we like the BEST are already skater names in singular or different spellings. Can we use these or is it considered Taboo? We are using the Two Evil's registry to check names.

I think the key is whether or not there could be confusion generated by the name. If two skater names are too close to each other, you could conceivably mistake one skater for another. But if a skater name and a team name are equally similar, there is far less of a chance of confusion. I doubt anyone would read your posters and excitedly drive to your bout expecting to see their favorite player singlehandedly playing another whole team. (Though I would plunk down money RIGHT NOW to see any skater who could pull that off!) This is ultimately a judgement call you have to make but if the team name isn't completely identical to the skater name, and especially if this is for intraleague team names that will never play against other leagues anyway, I think you're relatively unlikely to receive any flack about the similarity. If TwoEvils rejects it, do what more and more skaters and teams around the world are doing and just ignore them. (Edit: That's not a rebuke against the efforts of the TwoEvils folks, just a growing acceptance of the reality that as the number of leagues worldwide climbs toward four digits and the number of registered skater names soars toward the mid five digits, there just isn't any point to not using a name in Ireland because someone in New Zealand is using it.)

So there's my opinion on the subject. Feel free to poop all over said opinion down below in the comments.
This sorta smacked me to awareness of the fact that although I am now more active in the world of roller derby than I have ever been, the Derby Helper blog has been sitting here rotting like an 8-track tape factory.

"Welcome to Derby Helper world headquarters!"

There are a few reasons why my efforts are not translating into new Derby Helper articles and I thought it would be a good idea to let everyone know why.

Derby Earth
The Derby Earth project takes a decent chunk of my roller derby time. When someone submits an addition or change, I don't just blindly accept that it is accurate. I dig around the internet to confirm the submitted information and often discover that there are pieces that missing or inaccurate. My desire to make the placemarks zoom to the exact building location when double-clicked can lead to a ridiculous amount of searching around in Google Streetview to find a real position that was obviously wrong when the address is punched in to Maps. Basically, my own anal-retentiveness makes Derby Earth marginally more useful while simultaneously condemning me to hours of tedious busywork that I probably could get by without.

Coaching Juniors
Rather than continuing my old modus operandi of sitting on my internet high horse writing articles about how everyone else should do things, I finally put my money where my mouth is and co-founded a junior roller derby league that I help to coach and operate. I can happily say that this has been one of the most wonderfully rewarding things that I have ever thrown myself into. I can't even explain to you how fulfilling it is to me to have a new girl show up for the first time unable to even stand up in skates, to work with that girl on skating fundamentals 2 times per week and to see that same girl 6 months later playing jammer in a drill taking hits and giving them right back with a look on her face like every minute of practice is the best minute of her life. Junior roller derby is probably the main reason why Derby Helper has been on unintentional hiatus, simply because that is where the majority of my available roller derby time gets spent.

Health
My whole life, I've had a pretty high constitution (in nerd-speak, I rolled about a 16) so my whole adult life I never had to deal with any serious wellness problems with my self or anyone else in my household. Until the last 12 months that is. Suddenly in a ridiculous flurry of infirmity reminiscent of the Old Testament's Book of Job, I lost use of an arm, discovered I had a tumor, had to rush my wife to the emergency room multiple times, was told I had cancer (incorrectly thank goodness), took my wife in for several surgeries for the same problem, had surgery myself to fix the arm, shattered my tibia and fibula (kinda like this, if you're brave enough to watch it) , had two MORE surgeries myself and currently have to use a grandma-style walker to shuffle to the bathroom if I don't want to be forced to pee in a jug.

Though come to think of it, there is a third option...

The upshot is that it's hard to come up with new insights in the world of roller derby to share with my reader base when I'm busy singlehandedly bringing the entire healthcare system out of the recession. (If you work in healthcare and you've gotten a raise in the last year, you're welcome.) I've been so physically and emotionally drained by all of this that it has been a challenge just to keep Derby Earth and the junior roller derby running. The usual stream of ideas for article subject matter pretty much dried up as I sort of turned emo and started spending all my time feeling sorry for myself.

They even made a t-shirt about me.

Now that I've finally decided to cowboy-up, stop my personal pity party and grab life by the horns again, I'm hoping to start slowly but surely returning this space to being a consistent resource for useful roller derby information sprinkled with silly roller derby humor like it was in the good old days. It may be infrequent due to points 1 and 2, but I plan to not let point 3 be a factor in it anymore.

So there you have it, the State of Derby Helper. Thanks for all of your readership over the past 2 years and I look forward to doing everything I can to continue to develop and improve the body of information available to the world of roller derby for all of you. Remember, you can always send me your roller derby questions and you will get them answered either by my well-thought out, thoroughly convincing articles or by all the people in the article comments pointing out all the reasons why I'm an idiot.

I know several people involved with that league but this came as a shock to me. I tried to reach the various contacts I have gotten to know over the years but received no reply. The only thing I have found that vaguely resembles an explanation is this picture from the sports section of their local newspaper that was taken at their last bout on May 21st:

On the bright sidee, there are some kickbutt deals for skates and accessories listed on Craigslist in the Huntsville area right now.

(Thanks to Dixie Derby's eRacerX for sending me the pic!)

We told our ASCAP guy that we were covered by the rink licenses and he said we are not. The rink owner told us he would kick us out if he found out we had paid ASCAP. The rink owner has a different ASCAP representative. Any advice?

This isn't all that surprising. To reprise the earlier post on this subject, ASCAP is a legitimate organization with legitimate benefit to songwriters and publishers but in the past few years, some of their representatives have become highly overzealous and occasionally make payment requests that are legally questionable. To sum it up, "different ASCAP representative" clearly means that a second guy is trying to make a commission on the same venue. If the facility has paid a site license, public use of music in that facility is paid for no matter who is playing the music or who is listening to it. Next time he whines for money, give him an address where lawsuits can be delivered and tell him that he needs to sh** or get off the pot. I suspect he will keep nagging and threatening but the subsequent lack of a legal summons means he knows he's trying to double-dip and has no legal basis for his whining. For fun, take a picture of the ASCAP sticker on the front of the skating rink with the current year on it, send it to him and ask him why it doesn't have "except for roller derby!" anywhere on it.

Hi,
I've been a roller derby fan for about a year now, and I bring my camera to bouts to take pictures. Mostly I've been shooting the Old Capitol City Roller Girls, but I've been branching out and watching other leagues as well. What are the generally accepted practices for derby photography? Mostly I've gotten reactions of "Yay! Someone's taking pictures of us!" but I've also seen the "Only WFTDA-certified photographers with signed releases" rules at the championship tournament, and I'm wondering where things change. What if someone wants to use one of my photos in a publication (online or in print)? Where can I go to learn about my responsibilities, and what people expect of me? Can you help me find this information?

Thanks,

"KORfan"

This subject is covered by basic copyright law and while my grasp of the photography particulars isn't perfect (since I'm not a photographer), here's my quick summary:

In almost all situations, if you shoot a picture, you own the copyright. Unless it is a specific kind of work-for-hire (such as a portrait shop that employs you and provides the equipment and film), you can do whatever you want with any picture you take, derby or otherwise. A league can opt to not allow cameras in to bouts or practices at their discretion but as long as you're able to take pictures, you own them. Where law leaves off and etiquette takes over is that if a league likes one of your pictures and wants to use it for a brochure or their website or something like that, it is a generally accepted practice that you allow them to use it without compensation as sort of a "donation to the cause". That's not a legally enforceable demand, it's simply courteous compliance with roller derby's "Don't be a douchebag" rule. There are circumstances under which you could potentially owe a photography subject residuals if you publish a shot for money but I THINK that that does not apply in a situation like a live sporting event. I'm admitedly shaky on residuals so don't take my word for it. Hopefully I can get clarification from all you from the veteran photographers out there in Derbyworld.

If any of you have additional or better knowledge on photography rights and laws, put 'em in the comments and I'll add them to the body of the post under your name for everyone's benefit.
-----

Edit: This only covers US copyright law. If any of you have insight on the laws of a different country, please post in the comments!

Edit 2: Sometimes I'm right and sometimes I'm wrong. Let's see what Wet Spot has to say on the subject.

You're right and you're wrong.
Yup, the photographer owns the copyright and no one can take that away from them.
HOWEVER! This does not mean they can sell their work. If there is a model or subject in the photo or even if the photo is in a private space (venue is considered a private space) the photographer needs to get model releases and venue releases.
So if you take a photo of a jammer then you need to get that jammer's permission to sell that photograph and she may request a cut of the cash in exchange for permission.

Wet Spot

Edit 3: Here's an Australian perspective.

I'm a derby girl from Central Coast Roller Girls, Australia and a photographer who works at a major newspaper in Sydney.

In some cases if you publish or sell a photo of a person you require a signed model release from the person in the photo.

A league can say if they want photographers in a bout, hand out media passes and get them to sign a release, basically saying whatever they want. ie: the league can use any photo, league must approve publication of images, copyright can even be signed over to the league, most leagues wouldn't go this far, as photographers and leagues work together, but always read the fine print of the release so you don't loose copyright of your images. (Lots of bands make photographers sign similar releases when shooting gigs)

Photos on facebook can be used by anyone. For example, if there is a person who has committed a crime and we can legally name them, we sometimes grab a pic from facebook of the person. If its up there you can use it. Also if someone dies and there is a major news story going on we go on facebook and get pics of the people, not so nice but thats what happens. Check your privacy settings people :D And photographers, watermark your photos. :)
They give us all another calender year to look back on with 12 months of hindsight. If you're reading this, you no doubt are looking back at normal-life experiences sprinkled liberally with derby-life agony and ecstacy. My experience was similar for the most part but this particular January has been a little more introspective than average for me. Hopefully as I explain, you'll find some motivation to drive you to do the things that could make 2011 a year that you will look back on and be proud of.

I'll cut right to the chase. After initially thinking I had a non-serious problem, I was told by a doctor shortly before Christmas that I had a huge tumor and that a particular spot within it was cancer. Spoiler alert: It turns out that I do NOT actually have cancer. Don't freak out, I'm fine. But for a 17-day period spanning over Christmas, a mis-diagnosis by two different specialists had me thinking that I had a cancerous cyst. I bring this up for the simple reason that potentially life-changing information like that tends to make a person rethink their life just a wee bit.

In the same way that this is "just a wee bit" of snow.

What I found myself thinking about most was the things I had done that have had an observable impact. What had I done that was useful, helpful or significant? Who out there had had their life improved in any way as a result of knowing me? What had I not been doing that I wanted to or knew that I should? Had I changed anything, anywhere for the better?

The good news during those seventeen days is that I had some specific accomplishments to look back on in 2010. I had helped start a junior roller derby league and was privileged to watch as girls from all walks of life (some of whom couldn't initially even stand in skates,) worked hard, learned quickly and bonded together over what was clearly the most exciting thing they had done in their lives. I had shared information in this blog that I have since discovered had helped some people form new local leagues and had helped others reorganize and rebuild theirs. I had launched a resource that helps roller derby lovers discover and learn about leagues all around the world. These and several other things from my real life gave me comfort in knowing that I had had some sort of tangible, positive effect on people.

There were regrets too of course during this time period but I'm dwelling on the positives here for a reason and it is NOT so that I can sit here like a douchebag wallowing in a pool of self-aggrandizement telling you how cool I think I am. I'm telling you all this because the things that I was proudest of and that made me feel significant were the things that I had accomplished, things that I actually got off my butt and DID. Any one practice with my junior derby girls was better and more important to me than all my couchbound random internet surfing combined. Every "thank you" on Derby Helper or compliment on Derby Earth meant more to me than all the video games I beat or shows I watched. Now don't misunderstand me, all that stuff has its place in life and it is still part of mine. But I hope that those of you who randomly surfed your way here will take a moment to consider what you would be thinking about if you had spent 17 days with the C word hanging over your head and suddenly had it wiped away clean. What do you wish you had done last year and could you do it this year? What would be cool if it existed and could you be the one to make it? What could you be finishing six months from now if you started it right now? Whose lives can you make better? In roller derby terms, this line of thinking might mean you finally go to that derby 101 class and try out for the team, it might mean that you finally fill out the paperwork to organize that junior derby league you've been thinking about or it might mean that you start a new intense training regimen to carry your team to the championships. In real life terms, it may mean you quit the crappy comfortable job you have to pursue the career you've always dreamed of or it may mean that you and the spouse start saving up the money to do the adoption you've talked about for years. Whatever it is for you, I encourage you to get out there and do something this year that will make you proud when you're looking back at it in January 2012.

A very happy and healthy new year to you all.
D.H.

First of all, I'm well aware of which of your lists my name is on. Sorry about that but in my defense, when you combine 2-for-1 beers, a broken bathroom and a nearby easily accessible church confessional booth, nothing good is going to come of this situation. That said, I'm hoping that my sincere remorse and the 100 hours of community service will sway you to go ahead and bring me everything on my roller derby Christmas list that you'll find enumerated below. Thanks and I look forward to starting 2011 on the "Nice" list and plan to earnestly attempt to stay on it for more than 16 hours this time.

Love, Derby Helper

*********************

For Christmas, I want:

...a league to finally form somewhere in Africa so we'll have roller derby being played on 6 continents.

...someone to invent a temporary masonite floor that is as portable and easy to deploy as those cheesegrater sport courts.

...every league on earth to graduate from skating rinks and find an arena-style place to play that has padded seats and sells beer. (And doesn't have a broken bathroom.)

...a way to have ropelight track borders that cause no hazards for the skaters because that looks really, really cool.

...WFTDA leagues in Australia and New Zealand, plus more of them in Europe. Then, for Australia/New Zealand and Europe to each become a WFTDA region that has its own tournament and automatically sends their top one or two teams to the championship tournament.

...banked track roller derby somewhere other than American southwest so that Royal City can play someone other than themselves.

..."stand around in a line" roller derby to return to the flaming sewers of hell from whence it came.

...less blowouts at regionals & the championship tournament and more heartattack-inducing moments like the last jam of the Oly-Rocky Mountain final.

...to have junior roller derby explode the way that womens roller derby has, because I know that kids everywhere will jump at the opportunity the way they did here, and because it is one of the funnest and most gratifying thing I have ever gotten involved with. Plus I want to see what the game will look like when the first crop of adult skaters hits that started when they were 10 years old.

...a pony. Seriously dude, you've been shafting me on that request for decades now. What's the deal? I have a yard now you know.

Oh and one last thing Santa. Please fulfill all the roller derby Christmas wishes that my friends put down below in the comment section. Thanks dude, you're awesome!

Fortunately, I wasn't ashamed to beg for help from the derby community and equally fortunately, some of them had enough pity within their souls to chip in. As I chugged through the web researching my portion of the list and consolidating all the volunteer submissions with my own work into one database, I made a variety of observations that I would now like to share with you. Enjoy!

Isolation
Usually roller derby spreads bit by bit but occasionally it makes giant leaps into uncharted territory, leaving one lonely league standing far off all by its lonesome self. For example, located smack in the middle of the Australia you'll find Malice Springs Roller Derby.

Or as I like to call them, Australia's belly button.

Almost all of the population of Australia is crammed into a ring that hugs the shoreline. The location of Malice Springs at dead center of the contenent puts them 784 miles (1,270km) from their nearest potential competitor. Imagine if you were the London Rollergirls and the closest place you could go to play a game was just southwest of Stockholm Sweden or if you were the Windy City Rollers in Chicago and your closest team was Assassination City in Dallas. Looking at Australia in Derby Earth makes you think that Malice Springs just farted and all the other leagues ran for air. My guess is they'll pretty much have to fundraise their butts off just to be able to play one road game a year. An honorable mention in this category goes to Pacific Roller Derby in Hawaii who has a couple of leagues nearby but has to fly 2,400 miles to be able to play a WFTDA sanctioned bout.

Uncomfortable Proximity

Hawaii makes another appearance on this list in the form of two leagues that seem to be in a perpetual staredown. Zoom in on Kapaa, Hawaii and you'll see the following scene:

Wicked Wahine Derby Association and The Garden Island Renegade Rollerz practice at locations that are within line of sight of each other. Whenever I see this, I like to imagine that they are mortal enemies who always schedule practice on the same evenings at the exact same time, glaring across the road at each other as they get out of their cars and making that two-fingered "I'm watching YOU!" gesture before joining their respective team's practice. I also like to envision them occasionally sneaking over to the other league's parking lot to let the air out of each other's tires. If this is completely untrue, please don't ever tell me.

Extremes

Northernmost - The title for northernmost league known (as of this posting date) goes to Luleå Roller Derby from Luleå, Sweden who dot the globe at 65°35" north, beating out the Fairbanks Rollergirls by a mere 50 miles. At that latitude, I really hope they play on ice skates.

Southernmost - This one is still not confirmed. The unofficial winner is Dead End Derby of Christchurch, New Zealand who have the southernmost confirmed location at 43°31". We don't have a confirmed address for Otautahi Roller Derby who are also in Christchurch so at any moment, they could possibly step forth and wrest away the crown by providing us with an address. Stay tuned for the exciting conclusion.

Furthest Apart - The UWCSEA Roller Girls, a junior league located in Singapore, is a mind-boggling 11,990 miles or 19,295 km away from Roller Derby Bogotá in Bogotá, Colombia. That is within 1% of the longest distance that 2 places on earth can be from each other. UWCSEA only beat out the Chili Padi Derby Girls of Singapore by a paltry 3 miles so if both leagues stay right where they are, plate tectonics should make this title change hands in a few hundred-thousand years or so.

Internet Agony
New leagues that don't have much money or high-level web savvy at their command tend to use free resources like blogging sites or social networks to get themselves on the internet. In the course of confirming all the information in the Derby Earth database, I have been to very nearly every single one of these pages and having done so, I would like to take this opportunity to scream from the rooftops:

MySpace su-u-u-ucks!!!

Seriously, make it stop. Try FaceBook. Blogger. Tumblr. Wordpress. Friendster. LiveJournal. Weebly. Google Sites. Please please please host yourself on something that will not vomit into my eyeballs like the average MySpace custom theme. And for for the love of FSM, don't make it impossible for people who are interested in you to find information about you! If your roller derby web page does not tell people where and when you practice/play roller derby or how to contact you about roller derby, you fail at using the internet to promote roller derby. Helpful tip to all of you out there in the Derbyverse - if your league's placemark on Derby Earth doesn't zoom right down to the actual building you play in, it means we couldn't find you which means that your web presence is not helping your fans and potential recruits find you either.

Facts
There are roller derby leagues in...

5 continents

All 50 U.S. states

All regions of the United Kingdom

Altitudes from barely 10 feet above sea level (several) to approximately 7260 feet (The Naughty Pines Derby Dames)

10 different languages

---------------------------------
A big shout-out to the volunteers who researched and submitted all the league placemark information because without them, it would have been finished somewhere around January 2013.
Slay West - CNY Roller Derby
Skatee Frakoff - Dundee Destroyers
Brutali-Tease - Queen City Roller Girls
Lethal Dose - Alachua County Rollers
Crotch Rock-It - Pearl River Roller Derby
Later this week I'll post something about the process and the interesting quirks I've discovered out there in the derbyverse. Thanks volunteers, it wouldn't have been ready before 2012 without your help!
The problem is, a series of events have had me traveling non-stop through the northern and eastern US and will soon have me trolling my way across the midwest. I have had to cancel some fun stuff I had started like replaying the 2010 WFTDA Championship tournament bracket if the best uniform always won the game (spoiler alert: Oly came in dead last) as well my on and off track observations on the whole event. So instead of completely missing out, here are my highly abbreviated championship observations, all in 10 words or less:

Rocky Mountain played like beasts, deserved to win

UIC Pavilion - best derby venue I've been in yet

Seeing so many leagues attending to watch made me happy

I learned not to tweet/facebook while all drunked up

DNN does a great job at tournaments, give them money

I was too busy to meet everyone I wanted to

3 days of derby is not too much derby

If fandom was a tournament, Nashville fans would win championship

If fan costumes were a tournament, Bay Area wins

Thank goodness for unseasonably warm weather

Chicago mass transit was efficient and surprisingly clean

I need more sleep than I did in my 20's

Everyone at the tourney was happy to be there

I can't wait 'til next year

Alright, that will have to do it for now. No more posts until I announce that Derby Earth is open for business!
UIC Pavilion in Chicago, early November 2010. A place filled with the extremes of the 21st century human soul. A giant gathering that brims with high hopes, booming music, smiling faces, sparkly jammer panty booths, drunken internet rants, heartwrenching losses and ecstatic victories. But what single defining moment really captured the essence of this event in the most profound way?

Meh, I don't know either so instead here are pictures of a variety of skaters and fans from leagues around the world who came to watch the WFTDA Championship and who didn't think I was too creepy to let take their picture. Enjoy!
There are plenty more who have come all this way to watch the championship but sadly in many cases I have been unable to break off and talk to them because I was wa-a-ay too close to the front of the beer line. Enjoy the final everyone!
I'm working hard to finish upgrading the servers before the launch of Derby Earth and the WFTDA Championship so don't expect many posts until then. For those who missed it, there was a bit of a tempest in a teapot during the Western Regional over warpaint worn by a Rocky Mountain player that looked suspiciously similar to the blackface makeup that caucasian performers used to wear in vaudeville-era minstrel shows. I won't retrace all the ground covered in the RDIT article, I'll simply link it here so you can read it and then come back here for my commentary on the issue. Go ahead, I'll wait.

My spin on this is that there is a very positive takeaway in terms of perspective on where we are now versus where we used to be. If this had happened during most of the history of the United States, it would have been completely intentional and it not only would not have been controversial, it probably would have amused people and caused other skaters to follow suit. Back then, if any white person had raised objections, they would have been subjected to racially charged insults themselves and possibly been roughed up a bit. Hell, <strike>Echo</strike> Ecko probably wouldn't have been allowed to skate on the same team as white skaters. (That's not an exaggeration, see this for proof: http://en.wikipedia.org/wiki/Negro_League_baseball ) Those of us who, like me, are around the age of 40 or older instantly raised our eyebrows and said "uh oh" when we saw AJ's black warpaint. That's because we saw TV stations matter-of-factly broadcast old 1930's movies like the one where Mickey Rooney and Judy Garland sing a song called "Black Up For The Minstrel Show" as they slather shoe polish on their faces then put on a racially degrading skit. I would submit to all of you that it is an amazing and wonderful thing that a group of 20-somethings saw that same paint and had no clue that there was any unpleasant racial connotation to it because they had not been exposed to institutionalized, socially acceptable racism in the same way that we slightly older folks were when we were their age. I'm not saying racism is dead yet but in a weird, counter-intuitive way, this warpaint/blackface kerfuffle proves that in America, it is on its deathbed with a morphine IV drip. AJ, I'm honestly glad that it didn't occur to you and your team that your warpaint could be seen as uncouth. Hopefully your kids will be stunned in their late fifties while mind-surfing the long-forgotten corners of the Mnemonic Internet to learn that anyone was ever treated differently due to their skin color, sexuality, nationality or religion. And AJ, don't be scared off of the warpaint by all of this, just go for something that will actually be seen by us older folks as a subtle bit of a social commentary on the futility of racism, like this stylish and attractive motif:
The upcoming South Central tournament could arguably contain zero teams with that same guarantee due to having multiple teams that look like contenders one game and palookas the next. Given that fact, lets throw this poll wide open. Which three teams do you believe will make it through Amber Waves of Pain and go on to play in Chicago for all the marbles in November?
Voting Result: By number of votes, the derby public chose Texas #1, Atlanta #2 and KC #3.
Real result: KC #1, Texas #2, Nashville #3
So to make this interesting, I want to force everyone pick a side by using the following scenario:

You are forced by aliens with laser-knuckles to bet all of your worldly possessions on the winner of the Western Regional. You have two choices: the Oly Rollers or the entire rest of the field. Who do you choose?

----------------------------

(Postmortem: 62% chose Oly Rollers and went down in flames along with Oly's win streak.)
That's why as much as we all want to be watching every minute of every bout during the WFTDA regionals, we will spend every Friday being the best worker bees we can, focusing on our work and being thankful to have a fulfilling job working for such an attractive and successful boss. Yup that's all we do. No reason to read any further because that report you asked for will be on your desk any minute now just like you asked for. Love ya like one of my family, boss old buddy.

Alright screw that, here's the deal. Every one of us who works someplace with an internet connection is going spend as much time watching the Friday bouts on Derby News Network as we can without getting fired. So here's a way to maximize your boutwatching time and minimize your chances of getting busted by that snaggle-toothed old fart who signs your paychecks.

It all comes down to camouflage, people. If you plan ahead, you can easily set him/her up to fail to notice the browser window showing the bout. First thing in the morning, fill your screen with word processors and important-looking spreadsheets. Launch a music player with some sort of moving visualization window and softly play music all morning with that visualizer showing in one of the bottom corners of the screen like so:

No need to to look here, just playing some harmless music to help me work harder...

Make a point of getting the boss's attention at least twice for some work-related issue so they hear the soft music and see the moving thing in the corner that is clearly not distracting you from work in any way. Then later in the day when the first bout starts, you minimize that music player but leave it playing. Now open the DNN boutcast in a pop-out window, shrink it to the size of the music player window, turn down the bout audio and put it right in that corner where the music player was. Presto, camouflage! When the boss walks by later and hears soft music, he/she will expect something to be moving in that bottom corner so the video stream won't attract their attention. Make some convincing tippy-tap noises on your keyboard every so often to complete the illusion and you're home free for the rest of the day, or until the underdog team runs off a 16-pointer on the final jam to win by one and you involuntarily scream "F**K YEAH!" and do a rockstar slide down the aisle.
Unfortunately, one of the the surest realities of humanity is that as soon as anyone starts having any sort of success, some chucklehead is going to start demanding a piece of the action. It isn't often that I'm called upon to assist the roller derby community in dealing with those chuckleheads but today's reader question puts me squarely in that position:

I'm curious about ASCAP. They have contacted our team and others about paying them to play music. They find teams on the internet and chase them down. What gives? Is this a scam or for real?

Hitzy Blonde

ASCAP representatives get paid on commission so of course they'd love EVERYONE to pay them. But there isn't a quick and easy answer to the question of whether their request is legitimate or not. So lets take a look at what ASCAP is and why they're eying your wallet.

What They Are

ASCAP is a perfomance rights organization (P.R.O.) and their name stands for the American Society of Composers, Authors and Publishers. There are three such organizations in America: ASCAP, BMI and SESAC. (Other countries have virtually identical sorts of organizations like PRS in the United Kingdom and APRA in Australia.) All of these operate in a virtually identical manner so for simplicity's sake I'll stick to ASCAP for purposes of this article. What they all do is act as sort of a collection agency/advocacy group for people who compose music. Through a large network of electronic means and human legwork, they discover who owes money and how much to the composers that they represent, then they collect that money and distribute it in quarterly checks. P.R.O.s also do things like lobby congress to increase the statuatory rate paid for the use of music when those rates start to slip in relation to the rate of inflation.

Why They Exist

Back in the days before the existence of copyright law, it was not uncommon for famous authors of highly popular music to die completely impoverished. This is because once a song was written and published, it was legal for anyone else to sell copies of that music without paying the author. Once copyright laws were passed to protect composers, they suddenly had the right to keep others from copying and selling their work but not nearly the resources required to enforce it. ASCAP was the first performance rights organization to form and in its original, uncorrupted form, it is why popular songwriters went from barely scraping by to making comfortable livings from their work. The P.R.O.s basically do all the things for composers as a group that those same composers could not do for themselves as individuals. For a composer, signing on with ASCAP means that you get your earnings found and collected for you from a wide variety of individual sources and consolidated in one convenient check instead of trying to get hundreds or even thousands of different radio stations or venues to write you individual checks. They withhold a certain percentage of the money to cover operational costs but it is well worth it to the authors because there is no way each individual songwriter would have the resources to discover every radio station, album or venue that had made use of their work.

Do You Owe Them Money?
For roller derby leagues, the answer to this question is contingent upon a number of things. If you never play music at your roller derby events, absolutely not. If your practices and bouts are all held in a facility that already pays for yearly site licenses for music, then no you don't. If there are stickers on a window somewhere out front that look like these:

...then you're officially off the hook. Rollerskating rinks are a lock to have these licenses in place since they pretty much couldn't open their doors for business without them. If you practice and bout in a skating rink, congratulations, you may close your browser window and go back to watching "Teen Mom". From there though it gets less certain. Locations that host live music on a regular basis may have a yearly license that will cover you but it isn't guaranteed. City-owned places like civic centers vary by location and are not a lock to have a site license since they may not host enough music per year for it to be worth it. Hotel facilities will often buy a license for their bar and restaurant areas but leave their convention areas uncovered, leaving that responsibility to their renters. Warehouses and outdoor rinks are practically guaranteed to be uncovered, placing the licensing responsibility squarely on you. The only to know for sure where you stand is to contact the management of the facility that you use and ask them if they have music licensing in place or not.

We're not covered and we're broke. What now?
You could theoretically have no music at your bouts and rely on your announcers and crowd to provide ambience. But there's no denying that having a catchy beat in the background adds energy to any event. The good news is, it is possible for you to play music completely legally without paying performance rights organizations as long as you're willing to jump through a few hoops. The Creative Commons hosts a broad spectrum of musical mashups that are available to use for no cost as long as you follow the terms set by the creator of each individual work. There are currently over 500 Creative Commons licensed tracks available at SoundCloud with more being added every day. I highly recommend clicking that link, rooting around for awhile, using the search and seeing what is available. There's nowhere else I'm aware of that you can hear Soulja Boy get his swag on with Tom Petty so there are definitely some fun things in there. It is important to note that using Creative Commons works doesn't keep ASCAP from asking you for money, it just means that you can laugh and flip them the bird when they do.

So Hitzy, since your league plays in a convention center, there is likely to be some legitimacy to ASCAP's requests. Double-check with the management office there to know for sure. The good news is, it doesn't mean that they get a piece of the action for everything you ever do. Hopefully you can find enough material with Creative Commons licensing to take care of your musical needs. And when ASCAP asks you for money for past bouts, ask them for a detailed list of ASCAP songs that were played at those bouts. If they can't tell you what you played, they can't sue you for playing it. They might keep badgering you hoping to wear you down but hey, that's why God gave us middle fingers, right?

Hey derby veterans, share your experiences with performance rights organizations in the comments so we can all learn from them!

EDIT:
I liked this entry in the comments so much, I'm adding it to the body of the article. Mad props to Killah B. Killed for an awesome supplement to what I posted.

I'm the founder of Nashville's league and also an ex-employee at BMI, specifically for the Pre-Legal department so I understood the legalities and any exceptions to licensing. Long story short, after our first bout, I arrived in the morning to find BMI's "intro" letter on my desk...basically saying "Hey suka, we found you - at your desk, pay up." Not too long after that, ASCAP's letter arrived in the mail. If your league is generating press like it should, inevitably, they will find you. Also, as a side note, they have departments who jobs are to research and locate unlicensed opportunities.

Spanky's post is pretty accurate and along w/ his advise, don't be afraid to call ASCAP/BMI/SESAC directly and ask them questions. Like he said, if your facility is covered under a facility license your bouts should be covered. Our league was licensed under an Event license because we played in an unlicensed space and an Event license was the most appropriate for us. ASCAP should be able to inform you if your facility is covered and how.

Some things to be aware of when licensing:
1. Live music - this is the most expensive type to license. ie: avoid half-time bands.
2. DJ's - second most expensive.
3. Recorded - cheapest form.

All of these get added into a formula where attendance/square footage/seating determine an amount that gets multiplied by frequency per year.

A way around it is to have ONLY live music performed by an original band (no covers). By them performing, they are granting you the right to their music and therfore you don't need to license it through a PRO. Or, you can do what we did and chalk it up to the cost of doing business. Derby, as much as we hate to admit it, is a business.

Good luck!!

Killah

It showed the exact bout location and address, team colors, contact info etc. and was useful for finding leagues that you didn't realize were close to you. Sadly, I had to abandon it because it turned out that there were more leagues that you could fit into one map. Well due to the continued rapid growth of the sport, the numbers problem has gotten much worse since then as www.derbyroster.com is now listing 570 leagues and I know of at least a couple more forming that haven't even reached the list yet. The huge and ever-growing number of leagues with constantly changing information pretty much kills the whole project because anyone trying to wrangle all that information into one map would have to be some kind of idiot, right?

Calling all idiots!

That's right, I'm starting a project to put every derby league on the planet into Google Earth. The number of leagues and the time involved per league is such that in order to finish this before the world ends in 2012 (you knew about that, right?), I need a few volunteers to help me track down a set of information for every roller derby league in existence and key it in to the Google Earth interface. Volunteers should have a strong interest in roller derby, a high tolerance for pain, no need for any form of compensation, some spare time to kill and the ability to accept the fact that Derby Helper will shamelessly hog all the credit when this thing is done. If you're willing to take on a few states, provinces or countries worth of leagues to key in, email me at the contact address listed in the column on the right. Oh and just kidding about hogging all the credit and no compensation. I'll list the names of all contributors and they will be rewarded with unlimited nods of approval from derby lovers around the world.
